Overall privacy statement
We at Livescribe, Inc. take your privacy seriously. Because we gather certain types of information about our customers, we want to help you understand the terms and conditions surrounding the collection and use of that information. This privacy statement discloses the types of information we gather, how we use it, and how to correct or change it.

  1. What information does Livescribe collect?

    There are a few instances where Livescribe may collect information from you.

    When you buy products from Livescribe and our partners, we may ask you to register that product in order to gain access to support and other features. That registration may require that you provide personal information such as your name, email address, mailing address, and phone number, as well as demographic information such as your gender or occupation.

    To use certain features on our website such as posting on our blog or in our community forums, or to be notified about new products and services, we may also ask that you provide information such as your e-mail address and zip code and that you create a unique user name and password.

    Livescribe does not collect any of the content that you create with your Livescribe products without your express action and approval. Your Livescribe products may themselves collect and transmit to us basic usage information that is helpful to Livescribe in providing you with improved products and services.

    There may be other times in the future that Livescribe collects personal information from you. Livescribe will always make clear what information it is requesting.

  2. What is Livescribe's practice regarding cookies?

    Your Internet browser has a feature called cookies which stores small amounts of data on your computer about your visit to our websites. Cookies alone tell us nothing about who you are unless you specifically give us personally identifiable information, in which case we use the information to enhance your services in the ways described below. By adjusting your settings on your browser, you may elect not to allow cookies to be collected. You need to have cookies turned on to visit and use most of the features on our sites.

    We use cookies in a variety of ways, including:

    1. Accumulating and reporting anonymous, aggregate (data collected in mass), statistical information on website usage;
    2. Saving your password so you don't have to re-enter it each time you visit our site;
    3. Displaying information associated with you when you re-visit our site.

    Our sites may contain links to websites owned by other parties. Those websites may use tracking technologies such as cookies in a different way than we do, and are subject to their own privacy policies.

  3. How does Livescribe use the information it gathers?

    We generally use the information we gather to help us develop, enhance and improve the user experience with our products and services. This can include providing you with better customer service and support, informing you about new products and services, and otherwise making your user experience with Livescribe more enjoyable.

  4. How does Livescribe share the information?

    Personally identifiable information

    We will not make any of your personally identifiable information available to other companies or people, except when:

    1. You specifically agree that we can share that information.
    2. You volunteer information or create a public profile in the course of your participation in our community features such as forums, blogs, or other forms of public communication and interaction.
    3. You include personally identifiable information of yourself or others in the Paper Replay sessions, audio recordings, notes, or other content ("Your Content") you upload to Livescribe’s community features such as forums, blogs or community site. If you do, Livescribe will collect and store such information and will make it available to users to whom you’ve elected to share who could then share it with third parties. And, although Livescribe does not specifically process any personally identifiable information contained within Your Content, Livescribe may share your content—and the personally identifiable information it contains—with third-party vendors who provide us with storage and hosting services and with other entities in the case of a business transfer as described below.
    4. We hire third-party vendors to provide services such as customer support or data processing. These companies are only allowed to use the information in order to help us fulfill those services to you. We do not provide your information to these companies for their own, permanent use.
    5. We are required by law, such as when we respond to subpoenas, court orders, or legal process.
    6. We believe that your actions violate applicable laws, Livescribe's Terms of Use, or any usage guidelines for specific products or services, or threaten the rights, property, or safety of our company, our users, or others.

    Aggregate information
    We aggregate personally identifiable information and disclose it in a non-personally identifiable manner to our application developers and other third parties for development, marketing, promotional, and other purposes. We do not disclose to these entities any information that could be used to identify you personally without your knowledge and consent. We may provide them with aggregate information to enable them to develop and provide new products and services to our customers.

    Business transfers
    We are always seeking to improve our business. In accomplishing this objective, we may buy or sell a company, or one or more of the companies in our corporate family may merge with or be acquired by another company. If we sell a business, we may transfer some or all of your information as a part of the sale in order that the service being provided to you may continue or for other business purposes.

  5. What are my options?

    If you would rather not provide any of the information requested by a registration process, you do not need to register with us. You will not, however, be eligible for certain support and services related to your Livescribe product or service if you do not register.

  6. How will I know if the privacy policy is changed?

    Any modifications to our privacy practices will be reflected first within this area of our Web site. If there is a material change in our privacy practices, we will indicate on the privacy policy page of our site that our privacy practices have changed. If we are going to be using the information collected from users in a manner materially different from that stated at the time of collection, we will send affected users written notice of the change by e-mail.

  7. Privacy of children

    Livescribe recognizes that parents, guardians, or other adults may purchase our products for family use, including use by minors. We do not knowingly collect personal information from children under 13 for marketing purposes. If a child under 13 submits personal information to Livescribe and we learn that that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible.
